Terms and Conditions for the Rental of Holiday Apartments Subject of the Contract 1.1 These Terms and Conditions (T&Cs) govern the contractual relationship between the host (hereinafter referred to as the "Landlord") and the tenant (hereinafter referred to as the "Guest") regarding the rental of holiday apartments. 1.2 By booking a holiday apartment through Airbnb, the Guest accepts these T&Cs. Booking and Payment 2.1 The booking becomes binding as soon as the Landlord confirms the booking. 2.2 Payment is made in accordance with Airbnb's payment terms. The Guest is obliged to pay the total rental price as per the booking confirmation. 2.3 Additional fees (e.g., cleaning fees, security deposit) are listed in the booking confirmation and must also be borne by the Guest. Cancellation and Refund 3.1 Cancellations by the Guest must be made in accordance with the applicable cancellation policy on the booked platform. 3.2 In the event of cancellation by the Landlord, the entire amount already paid will be refunded to the Guest. Further claims by the Guest are excluded. Check-in and Check-out 4.1 Check-in is from 3:00 PM, and check-out is by 11:00 AM, unless otherwise agreed. 4.2 The Guest is obliged to adhere to the check-in and check-out times. The Landlord may charge additional fees for late check-out. Use of the Holiday Apartment 5.1 The holiday apartment may only be used by the persons specified in the booking. Additional guests are only permitted with prior agreement from the Landlord. 5.2 The Guest is obliged to treat the holiday apartment and its inventory with care and to report any damages or defects to the Landlord immediately. 5.3 Smoking is not permitted in the holiday apartment. Pets are only allowed with prior agreement. 5.4 Parties and events are not permitted in the holiday apartment. Liability 6.1 The Landlord is not liable for the Guest's personal belongings. The Guest is responsible for securing their valuables. 6.2 The Guest is liable for all damages to the holiday apartment or its inventory caused during their stay. Data Protection 7.1 The Landlord collects, processes, and uses the Guest's personal data solely for the purpose of processing the booking and fulfilling legal obligations. 7.2 Further information on data protection can be found in the Landlord's privacy policy on Airbnb. Miscellaneous 8.1 Amendments and additions to this contract must be made in writing. This also applies to the amendment of this written form clause. 8.2 Should individual provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a regulation that comes closest to the economic purpose of the invalid provision shall apply. 8.3 The law of the country in which the holiday apartment is located applies. The place of jurisdiction for all disputes arising from this contract is the domicile of the Landlord.
